10. Governing Law

These Terms are governed by the laws of the jurisdiction in which ExtremCommerce is registered, without regard to conflict of law principles.

11. Indemnification

You agree to indemnify and hold harmless ExtremCommerce and its affiliates from any claims, liabilities, damages, or expenses arising from your use of our services or violation of these Terms.

12. Dispute Resolution

In the event of a dispute, you agree to contact us first to attempt informal resolution before pursuing formal legal action.

13. For EU Users

If you are located within the European Union, you will be entitled to any mandatory consumer protections provided under the law of your country of residence.

14. U.S. Legal Compliance

You confirm that you are not located in a country under U.S. sanctions or listed as supporting terrorism.

15. Severability and Waiver

If any provision of these Terms is deemed unenforceable, the remaining provisions will continue in full effect. Failure to enforce any part shall not constitute a waiver.

16. Translation

In the event of a translation discrepancy, the English version of these Terms will prevail.

17. Service-Specific Terms

General Disclaimer

ExtremCommerce does not guarantee specific results from any service. Clients may be required to provide documentation based on platform policies. If documentation is not provided, ExtremCommerce reserves the right to end the project without refund.

Service Timelines

Service timelines may range between 2 to 60 days depending on complexity. Payment terms remain valid while work is in progress.

Termination

Either party may mutually agree to terminate a project. All payments are non-refundable unless explicitly agreed upon. ExtremCommerce may offer partial or full refunds at its sole discretion.

Non-Refundable Services

• Reinstatement Orders: Non-refundable once an appeal is filed. If no appeal is submitted within 90 days and the case is unsuccessful, a full refund will be issued.

• Creative Orders: Limited to 3 revisions. Additional revisions are billed at $300 per request.

Communication Policy

All website orders are processed via written communication. Verbal or phone support is billed separately at $400 per hour if requested.

Coaching Calls

Must be scheduled within 3 months of purchase. Unused time expires after 12 months from purchase date.

Warranty Disclaimer

Services are based on industry best practices and platform policies, which may change over time. All services are offered without guarantees or warranties.

Non-Solicitation Clause

You agree not to solicit any ExtremCommerce employee or contractor during service and for 1 year afterward. A breach results in a fee equal to the greater of $10,000 or the individual’s annual compensation.

SOP Licensing Terms

• Fees: SOP access is provided via annual subscription or one-time lifetime access.

• Usage: SOPs are licensed for non-commercial, internal business use. ExtremCommerce retains full ownership.

Feedback

Feedback submitted may be used to improve our services, with no obligation for compensation.

18. Updates to Terms

ExtremCommerce reserves the right to update these Terms at any time. Substantial changes will be communicated with a 30-day notice. Continued use implies acceptance of the revised Terms.
